What is the difference between mediation and arbitration?  Settlement at mediation is voluntary.  The parties hire a specially trained attorney or judge to act as a professional negotiator.  At the end of the mediation, you and your attorney can settle your claim, or refuse to settle your claim.  You might go home closer to settling, but without settling.

Arbitration is different.  Settlement in an arbitration is not voluntary.  In an arbitration, the plaintiff and defendant hire someone to act as their private judge.  The arbitrator will listen to arguments and read evidence, then issue a ruling.  The arbitrator will tell you who wins, who loses, and if money is involved, how much must be paid.  The case will be resolved at an arbitration.
